User Agreement

Effective Date: January 31, 2026

1. Acceptance of Terms

By accessing or using the "Gearbag - Texas Edition" mobile application (the "App") provided by Jayware ("Company," "we," "us," or "our"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Use of the App

2.1 Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years old.

2.2 License

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.

2.3 Prohibited Activities

You agree not to:

  • Use the App in any unlawful or unauthorized manner.
  • Attempt to gain unauthorized access to the App's systems or networks.
  • Reverse engineer, decompile, or disassemble the App.
  • Use the App to transmit any harmful or malicious code.

3. Subscriptions and Payments

3.1 Auto-Renewable Subscriptions

Gearbag - Texas Edition offers auto-renewable subscription plans. By purchasing a subscription, you agree to the following:

  • Subscription Title: Gearbag Premium Annual Subscription
  • Length: One (1) year from date of purchase
  • Price: $9.99 USD per year (legacy users: $4.99 USD per year)
  • Auto-Renewal: Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current period
  • Cancellation: You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings
  • Refunds: Refunds are handled according to Apple App Store and Google Play Store policies
3.2 Payment Processing

All payments are processed through the Apple App Store or Google Play Store. Your subscription will be charged to your App Store or Play Store account upon confirmation of purchase.

4. User Content

4.1 User-Generated Content

You may submit content, including text, images, or other materials, to the App ("User Content"). You retain ownership of your User Content, but by submitting it, you grant the Company a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, modify, publish, transmit, display, and distribute your User Content for the purpose of operating and improving the App.

4.2 Prohibited Content

You agree not to submit User Content that:

  • Infringes on any third-party intellectual property rights.
  • Contains false or misleading information.
  • Violates any applicable laws or regulations.
  • Is offensive, discriminatory, or harmful.

5. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which can be found here. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

6. Termination

The Company may terminate or suspend your access to the App at any time, without notice, for any reason, including your failure to comply with these Terms.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any errors or omissions in the App; or (d) any content posted on the App by any third party.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the state of Texas, without regard to its conflict of law principles.
